Tennessee Federal Courts

Because our offices in Atlanta are only a short drive away from Chattanooga, we also handle federal criminal cases in Tennessee on occasion. Just like the situation with the federal courts in Georgia, Alabama and Florida, there are three federal District Courts in Tennessee. However, the federal courts in Tennessee are in a different “Circuit”, which as discussed below has an impact on any appeal from a federal criminal matter arising in that State. Also, instead of being arrayed from north to south, the federal Districts in Tennessee are divided from East to West, which makes sense if you compare a map of that State to the borders of Georgia, Alabama and Florida.

The United States District Court for the Eastern District of Tennessee has courthouses in Chattanooga, Knoxville, Greeneville, and Winchester. While these cities are smaller than Atlanta, Birmingham or Miami, we have seen highly complex and sophisticated federal criminal cases brought in the Eastern District of Tennessee. As described elsewhere on this site, federal prosecutors (called Assistant United States Attorneys, or “AUSA’s”) are supported by very well-trained law enforcement agencies, such as the Federal Bureau of Investigation, the United States Secret Service, and the like. Additionally, most federal prosecutors are also exceedingly well-trained and experienced. Therefore, even if a federal criminal matter arises in a “smaller” city or location, that does not mean that a criminal defense lawyer is facing a lower caliber prosecutor. Some of the finest federal prosecutors in the country practice in smaller towns and rural locations.

The United States District Court for the Middle District of Tennessee conducts most of its business in the state capitol, Nashville. That Court also has Divisions located in Columbia and Cookeville, but far fewer matters are handled in those courthouses.

The United States District Court for the Western District of Tennessee has its main location in Memphis. That Court also conducts some business from time to time in the Divisional courthouse located in Jackson, Tennessee. While a large number of federal criminal matters arise in the city of Memphis, it is also not unusual for complex federal cases to come out of more rural areas in any of the federal District Courts in Tennessee. That State is the home to many large federal enterprises, such as the Tennessee Valley Authority, the Nuclear Power research facilities near Oak Ridge, along with several sizeable military complexes.

We handle lots of federal criminal appellate matters. If one side or the other is unhappy and wants to appeal a federal criminal case that was originally brought in one of the three federal District Courts in Tennessee, such an appeal goes to the United States Court of Appeals for the Sixth Circuit. That Court, the home base for which is located in Cincinnati, handles all federal appellate matters that come out of Tennessee, Kentucky, Ohio, or Michigan.
